Before you undertake any building work, make any changes to your building, occupy a premises or commence a new use on your land, you should check with Council and find out whether you are required to lodge an application. 

Some developments of a minor nature may be considered 'exempt development' and therefore no application is required, however, the development must satisfy certain criteria regardless of the construction cost.  

When submitting an application, go to the Reception area at Council's Administration Centre. Your Application will be given a preliminary check to see that it has been completed correctly. The application will then be lodged and an application fee will be payable.  An application fee quote can be obtained by contacting Council's Planning and Development Department by telephoning 67288202. 

The following forms (if applicable) can be used for lodging any of the applications discussed below: 

 
Development Application 
A Development Application is a formal application to Council for carrying out various types of 'development' as defined by NSW Planning Legislation and local Planning Instruments. Development includes activities such as new building works, alterations, additions, demolition, subdivision and use of land. A Development Application is seeking planning approval. 

At the time of lodgement, detailed plans and supportive documentation should be submitted to facilitate a timely assessment of your application.  Failure to provide Council with the information required will place the application on 'Stop the Clock' and will delay the assessment process.


 
Integrated and Designated Development
In accordance with the Environmental Planning and Assessment Act 1979 and the Environmental Planning and Assessment Regulations 2000, some development proposals are deemed to be 'Integrated Development' or 'Designated Development' that require approval of a State Government Agency (eg. Roads and Traffic Authority, Department of Environment and Climate Change, etc.). A link has been provided to the NSW legislation site for your convenience.

Construction Certificate 
A Construction Certificate is required in addition to a Development Application for any development involving building works. Such applications may be lodged and processed concurrently with Development Applications. A Construction Certificate Application is seeking building approval. 

Either Council or an accredited Private Certifier can issue a Construction Certificate as the Principal Certifying Authority (PCA).  At the time of lodgement, the owner must appoint a PCA.

Complying Development Certificate
Complying development is a quick, simple alternative to the Development Application process. Under the DA process each application is subject to a 'merit-based' assessment.  However, a Complying Development satisfies a range of pre-requisite planning standards and does not require the merit assessment.  A Complying Development is a building approval only. 

As is the case with Construction Certificates, Council or an accredited Private Certifier can issue a Construction Certificate as the Principal Certifying Authority (PCA).  At the time of lodgement, the owner must appoint a PCA. 

Inverell Shire Council currently operates under two pieces of State Legislation for the purposes of complying development.   These being State Environmental Planning Policy No. 60 - Exempt and Complying Development and State Environmental Planning Policy (Exempt and Complying Development Codes) 2008.  An applicant must specify which piece of legislation they wish their application to be assessed under.  Further information regarding State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 can be found at www.planning.nsw.gov.au/housingcode

Subdivision Certificate
A Subdivision Certificate is required for Council's endorsement of a subdivision plan prior to registration with the Department of Lands.  A Subdivision Certificate should only be submitted after a developer has fulfilled all conditions of the development consent.  The certificate is to be accompanied by the original plan of subdivision including administration sheet and four copies, an 88b instrument (if applicable) and the appropriate application fee. 

Sec. 68 Approval 
Sec. 68 of the Local Government Act 1993 requires that a person obtain Council approval for a variety of works.  A list of the most common approvals sought from Council is provided below: 
  • ¨ Install a manufactured home, moveable dwelling or associated structure on land
  • ¨ Operate a caravan park or camping ground
  • ¨ Operate a manufactured home estate
  • ¨ Install a domestic oil or solid fuel heating appliance
  • ¨ Install or operate amusement devices
  • ¨ Use a standing vehicle or any article for the purpose of selling any article in a public place
  • ¨ Carry out water supply, sewerage or stormwater work
  • ¨ Transport waste over or under a public place
  • ¨ Install and/or operate a system of sewage management

EXEMPT DEVELOPMENT
State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 (the Codes SEPP) specifies 41 exempt development categories under that Policy.  The Codes SEPP has statewide application and commences on 27 February 2009. Consequently, from that date the exempt development provisions (for the development types covered by the Codes SEPP) in State Environmental Planning Policy No. 60 - Exempt and Complying Development will no longer apply.

  • Certificate under section 149(2) identifying only the information set in clause 3 of schedule 4 of the EP&A Regulations 2000
